Is there such a thing as a "Direct Hire" in UAE?

 Common Question: I am a "Direct Hire" to work for a company based in Dubai or UAE. The company has processed and sent me an entry permit. Can I leave the country and pass immigration by presenting this document only?

The answer is no. While a valid visa is a requirement to secure your entry. You cannot fly out using an employment entry visa without an OEC or Overseas Employment Certificate. Now, to answer the question of "direct hiring", it is possible provided that your basic salary is above 4,000 and your visa designation is "highly skilled". If not, your company needs to apply for a verified Job Order from the Philippine Overseas Labour Office (POLO) in Dubai or Abu Dhabi, and partner with an authorized Manpower Agency in the Philippines.

Here are the steps and requirements for submitting a Job Order Application through a POEA-Licensed Agency. This procedure applies to companies seeking to hire skilled workers with a minimum basic wage (excluding allowances) of 1,500 AED.

  1. 1. Prepare Required Documents for Submission:

    Ensure most documents are on the company letterhead. Organize documents into 2 sets according to the provided list. Further details on these documents can be found below.

    • Recruitment Agreement: Customize the downloadable template with your company information. Print it on the company letterhead. This agreement authorizes the POEA Agency to process your staff's documents in the Philippines.

    • Job Order / Manpower Request (JO): Fill out this document with specific data, ensuring the applied position matches the visa designation. The salary breakdown must align with POLO's required standard base rates.

      • Basic Salary: Minimum 1,500 AED
      • Housing Allowance: Minimum 700 AED
      • Food Allowance: Minimum 300 AED
      • Transportation: Minimum 300 AED

      If housing and transport are provided by the company, these amounts needn't be added to the salary breakdown. The JO's salary offer should match the position and profession to meet POLO's strict guidelines.

      For submission:

      • If the UAE visa is issued, submit Visa Copy, Passport Copy & MOHRE Contract.
      • If the visa application is pending, submit the Company Visa Quota from MOHRE, ensuring alignment with the JO designation and quota availability.
    • Company Trade License: Provide the company's business license or Professional Register Certificate. Education sector entities like schools also require MOE License or equivalent.

    • Owner's Personal Documents:

      • Emarati owners: Copy of Passport and Emirates ID.
      • Foreign owners: Copy of Passport, Emirates ID, and Visa.
    • Philippine Recruitment Agency (PRA) POEA License and Owner's Passport Copy: These documents are supplied by your Partner agency to verify their capability to process the manpower request in the Philippines.

    • Master Employment Contract (MEC): Download and fill the format, stamp with the company seal, and sign on each page.

    • Additional Requirements: To validate the hiring company, provide printed photos of the office site, including the logo, address, and various areas. If accommodation is provided, submit housing photos including living, sleeping, kitchen, and bathroom areas, along with the address.

 

 2. Submit Documents to POLO - Dubai:

  1. Visit POLO DUBAI on Mondays, Wednesdays, or Fridays, ideally around 8 AM. Inform the guard that you're there for a Job Order. Receive a number and proceed to the designated room. Only authorized individuals can process these documents for the company. 

  1. Authorized Persons:

    • Company Owner/Employer: ID, Company Trade License, Proof of Ownership.
    • Employees: Employment proof (visa, Company ID, etc.), Emirates ID, and an authorization Letter.
    • Philippine Recruitment Agency (PRA) Liaison Officer with POEA accreditation.

 3. Submission and Processing:

  1. The POLO officer will provide information about the process upon submission. If all requirements are met, Job Order approvals usually take 7-14 working days. You'll be notified once the papers are ready for release.

 4. Release and Forwarding:

  1. Once released, send the documents to your partner agency for submission to POEA - Philippines. The worker should then undergo medical examinations, submit necessary documents, attend Pre-Departure Orientation Seminar (PDOS), and apply for Overseas Employment Certificate (OEC) to travel as an Overseas Filipino Worker.
